Terms of Service

1. Acceptance of Terms

By creating an account or using the Ascend mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Social Climb ("we", "us", "our").

2. Account Registration

To use Ascend, you must create an account using a valid email address and password. You must be at least 13 years of age to create an account. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@socialclimb.uk if you suspect unauthorized access to your account.

3. Description of Service

Ascend is a gamified activity tracking application designed for sales professionals. The App allows you to log professional activities such as calls, meetings, and deals; earn experience points (XP) and level up; compete on leaderboards; join social groups ("Circles"); send messages to other users; and track your performance over time.

4. Subscription Terms

Ascend offers a free tier and a paid subscription tier ("Ascend Pro"). Ascend Pro is available as an annual subscription at approximately $35 per year. Prices may vary by region and are subject to change.

Subscriptions are processed through Apple App Store or Google Play Store via RevenueCat. By subscribing, you authorize recurring charges to your app store account. Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period.

To cancel your subscription, manage it through your device's app store settings. We do not process cancellations directly. Refunds are handled according to the policies of the Apple App Store or Google Play Store.

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending accounts, or reporting to law enforcement.

6. Your Content

You retain ownership of any content you create through the App, including activity logs, messages, and profile information ("Your Content"). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute Your Content solely for the purpose of operating and improving the App.

You are responsible for Your Content and represent that it does not violate any third party's rights. We may remove any content that violates these Terms or that we find objectionable at our sole discretion.

7. Intellectual Property

The App, including its design, features, code, graphics, logos, and all related intellectual property, is owned by Social Climb and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

The Ascend name, logo, and all related marks are trademarks of Social Climb. You may not use our trademarks without prior written permission.

8. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the App, or for any other reason at our sole discretion.

You may delete your account at any time through the App's Settings. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy. Some data may be retained in anonymized or aggregated form.

The following sections survive termination: Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the App will be uninterrupted, secure, or error-free. We are not responsible for any decisions you make based on information provided through the App. Ascend is a productivity and activity tracking tool, not a guarantee of professional success.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIAL CLIMB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

11. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by email. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically. The "Effective Date" at the top indicates when the Terms were last updated.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the United Kingdom.
